
General terms and conditions of sale
1. Subject matter
These General Terms and Conditions of Sale (GTCS) apply to bookings made directly with Les Kotas du Bonheur holiday cottages, via the website, by e-mail or by telephone.
The customer acknowledges that he/she has the legal capacity to contract and declares that he/she is making the reservation for his/her own personal use.
2. Reservation
The reservation becomes firm and definitive after:
-
written validation (e-mail or online confirmation),
-
payment of a deposit of 30% of the total cost of the stay.
The owner reserves the right to refuse any booking that is incomplete or does not comply with the booking conditions.
3. Price and taxes
Prices are quoted in euros, inclusive of all taxes.
They include all utilities (water, electricity, heating, spa access), unless otherwise stated.
Tourist tax may or may not be included, depending on the terms and conditions specified at the time of booking.
The owner reserves the right to change prices at any time, without effect on confirmed bookings.
4. Terms of payment

Deposit: 30% on reservation

Balance: due 8 days before arrival
If the balance is not paid when due:
-
the reservation is considered cancelled by the customer,
-
the account is retained by the owner,
-
the owner will be able to re-let the property.
5. No right of withdrawal
In accordance with article L221-28 of the French Consumer Code, the customer does not benefit from the right of withdrawal for accommodation services provided on a specific date.
6. Cancellation policy – Customer
All cancellations must be notified in writing (e-mail or post).
The following conditions apply:

More than 30 days before arrival date:
→ full reimbursement of the deposit
a deduction for management fees may be applied

Between 30 days and 8 days before arrival:
→ 50% of the total cost of the stay is due -
Less than 8 days before arrival or no-show:
→ 100% of the stay is due
If the property is re-let for the same period, a full or partial refund may be made, less any expenses incurred.

7. Cancellation – Owner
In the event of exceptional cancellation by the owner (force majeure, technical problem, unavailability), the customer will be refunded the full amount paid.
No additional compensation may be claimed.
The owner may offer an equivalent alternative accommodation without any obligation on the part of the customer to accept it.
8. Arrival – Departure

Arrival: from 3pm

Departure: before 10am
In the event of late arrival without notification, the reservation may be considered cancelled without refund.
9. Security deposit
A security deposit is required on arrival.
It may be withheld in whole or in part in the event of:
-
damage,
-
non-compliance with internal regulations,
-
insufficient housekeeping,
-
abnormal use of equipment.
10. Use of the premises
The customer agrees to:
-
respect premises, equipment and exteriors (green spaces, playground),
-
respect the neighborhood (quiet after 10pm),
-
do not hold any unauthorized parties or events,
-
use the spa in accordance with the instructions.
In the event of non-compliance, the owner may:
-
interrupt your stay,
-
evict occupants without reimbursement.
11. Capacity and occupancy
The number of people is strictly limited to the capacity indicated.
Any undeclared additional person may result in:
-
a refusal of access,
-
or immediate cancellation without refund.
12. Animals
Pets are not allowed, except by prior written agreement.
13. Liability
The customer is responsible for all damage caused by him/herself or his/her companions.
The owner declines all responsibility in the event of:
-
theft, loss or damage to personal belongings,
-
accident linked to improper use of equipment (spa in particular),
-
force majeure (bad weather, power cuts, etc.).
14. Insurance
The customer certifies that he/she is covered by civil liability insurance.
15. Personal data
The data collected is used solely to manage reservations and is not passed on to third parties.
In accordance with current regulations, customers have the right to access, modify and delete their data.
16. Disputes – Mediation
In the event of a dispute, an amicable solution will be sought as a priority.
Failing this, the customer may have recourse to a consumer mediation mechanism in accordance with the provisions of the French Consumer Code.

17. Acceptance
Validation of the reservation implies full acceptance of these terms and conditions.
